Terms and Conditions

§ 1 Scope

These General Terms and Conditions (GTC) apply to all contracts between NEUSTART Verkehrspsychologische Praxis Cabuk, Düsseldorfer Straße 8, 47239 Duisburg (hereinafter “Provider”) and the client (hereinafter “Client”) regarding traffic psychology counseling and preparation services.

§ 2 Scope of services

The Provider renders traffic psychology counseling and preparation services in connection with the MPU (Medizinisch-Psychologische Untersuchung). The type and scope of services are discussed in the initial consultation and determined individually.

The Provider does not guarantee that the client will pass the MPU. The outcome of the assessment depends on many factors beyond the Provider’s control.

§ 3 Commencement and duration of contract

The contract is established by acceptance of the counseling offer and scheduling of the first counseling session. The duration depends on the individual scope of counseling.

§ 4 Fees and payment

Fees are discussed in the initial consultation and agreed upon in writing before counseling begins. The initial consultation itself is free of charge.

Invoices are due within 14 days of the invoice date without deduction, unless otherwise agreed.

§ 5 Cancellation and rescheduling

Appointments may be cancelled or rescheduled free of charge up to 24 hours before the scheduled time. In the event of later cancellation or non-attendance, the Provider may charge a cancellation fee equal to the agreed session fee.

§ 6 Confidentiality

All information shared during the counseling process is treated confidentially. Disclosure to third parties only occurs with the express consent of the Client, unless legal obligations require otherwise.

§ 7 Liability

The Provider is liable for damages only in cases of intent and gross negligence. Liability for slight negligence is excluded unless essential contractual obligations are breached.

§ 8 Final provisions

The law of the Federal Republic of Germany applies. The place of jurisdiction is Duisburg. Should any provision of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
